Reason for the nomination: While we have a creative commons licence for the photograph, we have no details about the depicted artwork, other than it is hung up in a pub in Innsbruck, Austria (though Google Lens suggests it is hung up in a cafe in Innsbruck instead). The uploader has confirmed that they don't have any knowledge about the creator or age of the depicted art. On the Village Pump, User:Herbert Ortner suggests that these types of artwork are often modern day creations for tourists and in most cases won't be PD.[1] Looking for other justifications for retention, COM:FOP Austria says we need to meet 3 tests for retention if the original work is not public domain. 1. It is a 3D artwork, so meets the first test. 2. It is hung up in a pub or cafe, which should be considered a public place, so it meets the second test. 3. It is on permanent display; we are unable to make a judgement on this as the pub or cafe may change its decor on a fairly regular basis - this appears to be hung on the wall so is easily moved or replaced. Unless I am being too harsh with my interpretation of Austrain Freedom of Panorama (this is my first encounter with it) I think this will need to be deleted.
